“In a significant verdict, a special sessions court in Rampur, Uttar Pradesh, on Saturday acquitted Samajwadi Party leader Azam Khan and his son Abdullah Azam in a 2019 attempted murder case. However, the court upheld their seven-year sentence in a separate four-year-old forgery case. Special Sessions Judge Vijay Kumar granted relief to Azam Khan, his son, and two other relatives in the attempt to murder case, citing a lack of evidence, as confirmed by Senior Prosecution Officer Amarnath Tiwari. The charges revolved around allegations that Azam Khan, Abdullah Azam, and two relatives had threatened a neighbor to vacate a plot of land, leading to a charge sheet under relevant sections of the IPC, including 307 (attempt to murder) and 323 (causing grievous hurt).”


“In a parallel legal development, a special sessions court addressing a case registered in 2019 has rejected a plea by Samajwadi Party leader Azam Khan, his wife Tazeen Fatima, and their son regarding the seven-year imprisonment sentence imposed on them by a lower court on October 19. The legal matter in question pertains to a fake birth certificate case, and the trio had lodged an appeal against the lower court’s decision in the special sessions court.

After a comprehensive hearing on the appeal, Special Sessions Judge Vijay Kumar dismissed the plea, asserting that there were no legal errors in the judgment rendered by the lower court, according to Senior Prosecution Officer Amarnath Tiwari.

This verdict underscores the legal intricacies surrounding the individuals involved and highlights the divergence in outcomes across different cases. While the attempt to murder charges were dismissed for lack of evidence, the rejection of the appeal in the fake birth certificate case maintains the seven-year imprisonment sentence for Azam Khan, his wife, and their son.”

“Azam Khan, a seasoned politician with a remarkable ten-term record as an MLA, has held positions in both the Lok Sabha and the Rajya Sabha. His son, Abdullah Azam, secured victory in the 2022 assembly election from the Suar constituency on a Samajwadi Party ticket. However, in February, Abdullah Azam faced a setback when a Moradabad court convicted him in a 2008 case involving wrongful restraint and assault on a public servant to deter him.

Following his conviction and a subsequent two-year jail term, Abdullah Azam was swiftly disqualified from the Uttar Pradesh Legislative Assembly. Despite seeking a stay of the conviction from the high court, his plea was rejected. According to the Representation of the People Act (RPA), 1951, individuals sentenced to imprisonment for two years or more face disqualification ‘from the date of such conviction.’ Furthermore, this disqualification continues for an additional six years after the completion of the jail term.”
